digIT Data Preservation

Upon notice or reasonable anticipation of a lawsuit, the preservation of data and metadata is the first responsibility of the client and outside counsel.

The new Federal Rules of Civil Procedure, which came into effect the 1st of December 2006 now specifically state, that electronically stored information (ESI) must be preserved in its original electronic form. It is not sufficient to make a hard copy of electronic documents.

DigIT Technologies’ software application is purposely designed to meet the needs of legal teams. When using digIT Enterprise to search and collect all relevant ESI, once relevant information is selected for export, a forensically sound copy using a multi-threaded utility is created of the electronic information then placed in a preservation repository. It is from this repository that additional searches of the documents and the exporting to a review tool are carried out.

digIT Enterprise helps companies to establish best practices for the preservation of ESI. Through the use digIT’s Alerting feature which advises an appointed Administrator whenever new, relevant information is created, or previously searched information is deleted or changed as well as digIT’s comprehensive reporting capabilities which show what was information was preserved and what was not, demonstration of “good faith” to the Courts is no longer in question.
